Terms of Use

1. Eligibility

You must be at least 13 years old to use the Site, or 16 if you are located in the European Economic Area or the United Kingdom. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement of a parent or legal guardian. By using the Site, you represent that you meet these requirements.

2. About the Site

Pokedexgenerator.com is an independent Pokémon fan site. We provide informational content, reference guides, and interactive tools - including a Pokémon builder/generator that allows you to create configurations, such as Pokémon Showdown-compatible team and set text, that you can copy and use elsewhere. The Site is provided for personal, non-commercial use only.

We are an unofficial fan project. Pokémon and all related names, characters, images, and trademarks are the property of Nintendo, Game Freak, Creatures Inc., and The Pokémon Company. We are not affiliated with, endorsed, sponsored by, or specifically approved by any of these companies.

3. License to Use the Site

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial enjoyment of Pokémon-related content.

Except for content owned by third parties, including content owned by Nintendo, Game Freak, Creatures Inc., and The Pokémon Company, the design, layout, text, graphics, code, and original content of the Site are owned by Gacha King LLC and are protected by intellectual property laws. You may not copy, reproduce, distribute, publicly display, modify, or create derivative works of any part of the Site except as expressly permitted by these Terms or by applicable law.

4. Your Generated Content

The Site includes tools that let you build, configure, and export Pokémon sets, teams, and similar content (collectively, “Generated Content”) - for example, text formatted for import into Pokémon Showdown.

• You are responsible for any Generated Content you create using the Site and how you use it outside the Site.
• Generated Content is created locally for your personal use; we do not claim ownership of the specific combinations or text strings you create.
• Generated Content is, however, derived from Pokémon intellectual property owned by Nintendo, Game Freak, Creatures Inc., and The Pokémon Company. Your ability to use Generated Content commercially or publicly is limited by those companies' rights, not by us.
• You may not use Generated Content for any unlawful, fraudulent, or commercial purpose, or in any way that would violate these Terms or another platform's rules, such as Pokémon Showdown's rules.

5. Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Site, its servers, or any related systems.
• Interfere with, disrupt, or place an unreasonable load on the Site, for example through denial-of-service attacks.
• Scrape, crawl, or harvest content from the Site using automated means without our prior written permission, except for well-behaved search engine indexing.
• Reverse engineer, decompile, or attempt to extract the source code of the Site or its tools, except as permitted by applicable law.
• Block, hide, click-fraud, or otherwise interfere with the advertising that supports the Site, or use tools designed to defraud our advertisers.
• Use the Site to distribute malware, spam, or other harmful content.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Site in a way that infringes the intellectual property rights of Nintendo, Game Freak, Creatures Inc., The Pokémon Company, or any other rights holder.

6. Advertising and Free Access

Pokedexgenerator.com is free to use and is supported by advertising. Advertising revenue covers hosting, infrastructure, content creation, and the other costs of keeping the Site online. By using the Site, you acknowledge that ads will be displayed and that information may be collected and processed by our advertising partners as described in our Privacy Policy.

7. Third-Party Content and Links

The Site may include links to or content from third parties, including official Pokémon resources, competitive battling platforms, and other fan sites. We do not control and are not responsible for any third-party content, websites, services, or practices. Your use of any third-party site is at your own risk and subject to that site's own terms and policies.

8. Intellectual Property Complaints

We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright or trademark, please contact us at [email protected] with:

• A description of the work you believe has been infringed.
• The URL or specific location of the allegedly infringing content on the Site.
• Your contact information.
• A statement that you have a good-faith belief that the use is not authorized.
• A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the rights holder's behalf.

We will review and respond to valid notices in accordance with applicable law, including the Digital Millennium Copyright Act (DMCA).

9. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AND GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GACHA KING LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that the information on the Site, including game data, stats, movesets, and competitive recommendations, is accurate, complete, or current. Competitive viability of any Generated Content depends on factors outside our control, including changes made by Nintendo, Game Freak, The Pokémon Company, or platforms such as Pokémon Showdown.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GACHA KING LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE - WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Gacha King LLC and its members, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your use of the Site; (b) your Generated Content or the way you use it; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason - including if we believe you have violated these Terms. You may stop using the Site at any time. Provisions that by their nature should survive termination, including sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law, will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will revise the “Effective Date” at the top of these Terms and may provide additional notice on the Site. Your continued use of the Site after the changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction and venue of those courts. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your country or state of residence.

15. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gacha King LLC regarding the Site and supersede any prior agreements.
• Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.
• No Waiver: Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision or our right to enforce it later.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely.
• No Third-Party Beneficiaries: These Terms do not create any rights for any third party.
